A U.S. District Court judge this week allowed a lawsuit to = proceed=20 against Irondequoit by retirees whose health insurance benefits = were=20 reduced in 2001.=20

On Tuesday, Judge David G. Larimer dismissed portions of = the suit,=20 declined to reclassify the suit as a class action and declined to = issue a=20 summary judgment in favor of the retirees.=20

However, Larimer also refused to dismiss portions of the = suit=20 claiming age discrimination and breach of contract.=20

"We are very happy with this decision and very comfortable = with the=20 decision," said the retirees' attorney, J. Nelson Thomas of Dolin, = Thomas=20 and Solomon PC.=20

"This is a great victory for the retirees."=20

The case was filed in July 2001 by town retirees Hubert = Lawrence,=20 Amelia Fontana, Roger Fox and John Magin. They claim Irondequoit = officials=20 breached an agreement with nonunion retirees in March 2001 when = the town=20 changed their health coverage from BlueCross BlueShield Blue = Million=20 Preferred to the less expensive Blue Choice Senior plan.=20

Arguing before Larimer in May, town attorneys claimed = Irondequoit=20 was only obligated to continue giving retirees BlueCross = BlueShield=20 coverage, not a specific plan.=20

Under the new insurance benefits package, retirees age 80 = or older=20 kept their existing coverage, while retirees 65 to 80 were = switched to=20 Blue Choice Senior and retirees 64 and younger were given Blue = Choice=20 Select.=20

Blue Choice Senior carries higher out-of-pocket costs for=20 prescription drug coverage.=20

Retirees could elect to keep Blue Million if they picked up = the=20 monthly difference in premium.=20

Thomas said it is possible his clients could come to a = settlement=20 with the town.=20

But, he added, "we will go back to court if we have to go = back to=20 court and we will try it (the case) and we will win it."=20
